SALES CONDITIONS, IN GENERAL Special considerations for individual products must be noticed and will appear from Technical descriptions in general, specific Product data and the Installation- and cleaning guide . Defects For the delivery in question, Ege Carpets guarantees for visible and hidden defects and shortcomings attributed from faults in materi- al and processing. Visible defects and shortcomings must be reported immediately by filling in a written statement with an indication of the shortcomings. The right to invoke lack of conformity lapses if the cutting or processing of the product is initiated. It is the responsibility of the buyer/customer to check colour matching and pattern repeat prior to installation of carpet rolls to be installed next to each other. The burden of proof rests with the buyer/customer for a suitable and flawless subfloor, correct treatment and compliance with the Installation guide . If for different reasons it becomes necessary to install defective goods provisionally, double sided adhesive tape has to be applied to the defective area. In case of replacement of carpets in relation to findings of defects/shortcomings, Ege Carpets covers the following costs: RETAIL CARPETS, DISMANTLING AND CLEANING RETAIL CARPETS, INSTALLATION CONTRACT CARPETS, DISMANTLING AND CLEANING CONTRACT CARPETS (LESS THAN 100 M²), INSTALLATION + ADHESION CONTRACT CARPETS (MORE THAN 100 M²), INSTALLATION + ADHESION OR ON HOURLY BASIS 2,00 EUR / M² EX VAT 4,00 EUR / M² EX VAT 4,00 EUR / M² EX VAT 9,50 EUR / M² EX VAT 7,50 EUR / M² EX VAT 48,00 EUR / PER HOUR EX VAT The price is agreed on individually with the factory. Work that must be carried out outside normal office hours has to be agreed upon and approved by Ege Carpets prior to commencing the work. The price per hour outside normal office hours will be an additional 50%. In case of mis-delivery Ege Carpets is not to be held responsible for covering the ensuing costs in relation to installation or disman- tling. Hereunder loss of rent, removal of furniture, change of installations, operating loss, time waste, salary costs or other disadvan- tages. Return Delivered carpets are only to be credited if they are returned after preceding written agreement with Ege Carpets and if wrapped and marked satisfactorily. Otherwise the product is returned at the buyer/customer’s expense and risk. Product liability Ege Carpets is only to be held responsible for personal injury if it can be proven that the injury is caused by mistake or negligence committed by Ege Carpets or others whom Ege Carpets are responsible for. Ege Carpets is not responsible for damage to property or effects once the delivery is in the buyers possession. Ege Carpets is not responsible for damage on products manufactured by the buyer or for products in which they form part. Ege Carpets is responsible for damage to property and effects under the same conditions as for personal injury. Ege Carpets is not responsible for operating loss, lost earnings or other indirect losses. In case Ege Carpets should be charged prod- uct liability to a third party, the buyer is obligated to hold Ege Carpets indemnified to the same extent as Ege Carpets responsibility is limited according to the three previous paragraphs. If a third party put demands against one of the parties about liability for damages in relation to this point, this party must immediately inform the other party.
